ACG09 Clinical Faculty Appointments for Milton S. Hershey Medical Center Physicians and Health Care Providers (Formerly HRG09)

APPLICABILITY:

This policy shall apply only to those physicians and other health care providers who hold faculty appointments from The Pennsylvania State University ("University") and also furnish clinical services through employment with The Milton S. Hershey Medical Center ("MSHMC").

TERMS OF APPOINTMENT FOR TENURE-ELIGIBLE AND TENURED FACULTY EMPLOYED BY MSHMC:

University faculty appointments with tenure or tenure-eligibility for physicians and other health care providers employed by MSHMC shall be made without University employment, but otherwise such faculty appointments shall have all the rights, benefits and privileges commensurate with the designated rank and title, as set forth in applicable University policies.

In the event of a voluntary termination from employment at MSHMC, a tenure-eligible or tenured faculty member shall be deemed to have voluntarily terminated his or her faculty appointment in the College of Medicine effective on the same date the voluntary termination from MSHMC becomes effective; provided, however, that by agreement of the Dean of the College of Medicine and such faculty member, the faculty appointment may be continued upon mutually acceptable terms.

In the event of an involuntary termination from employment at MSHMC, a tenure-eligible or tenured faculty member shall be offered employment in the University's College of Medicine. Such faculty shall be assigned to the same department (unless otherwise agreed by the faculty member and Dean of the College of Medicine) and continued in the same rank. The faculty member's compensation shall be determined according to the Academic Compensation Plan adopted by the College of Medicine in February 1998 or a similarly approved successor policy. The exact figure shall be agreed upon by the faculty member and the chair of his or her academic department with the approval of the Dean.

In the event the College of Medicine determines that the basis for involuntary termination of a faculty member's employment at MSHMC implicates any of the reasons set forth in AC23 for the termination of tenure-eligible or tenured faculty for adequate cause, the University shall have the right to institute proceedings under AC23 for the termination of any such faculty member's appointment.

TERMS OF APPOINTMENT FOR ALL OTHER FACULTY EMPLOYED BY MSHMC:

All other faculty appointments for physicians and other health care providers employed by MSHMC shall be made by non-tenure line appointments in a manner consistent with University policies applicable to such faculty appointments, without University employment. In the event of a termination from employment at MSHMC for any reason, voluntary or involuntary, the faculty appointment then in effect shall not be renewed, or shall be terminated prior to the end of the appointment term consistent with applicable policies and procedures, except as may be otherwise agreed by the Dean of the College of Medicine and the faculty member.

EFFECT OF TERMINATION OF FACULTY APPOINTMENTS ON EMPLOYMENT AT MSHMC:

In the event a faculty member's appointment with the College of Medicine terminates for any reason, whether voluntary or involuntary, the faculty member's employment at the Milton S. Hershey Medical Center will be deemed to have terminated effective the same date the termination of the faculty appointment becomes effective.
